PLEASE READ THESE TERMS CAREFULLY. THESE TERMS GOVERN USE OF THE SEA & SUN TRAVEL AGENCY WEBSITE, INCLUDING PRIVATE OR RESTRICTED-ACCESS PAGES AND SERVICES ACCESSIBLE THROUGH IT.

The Website is owned and operated by Sea & Sun Travel Agency, LLC, a South Carolina limited liability company (“Company,” “Sea & Sun Travel Agency,” “we,” “our,” or “us”). Our Privacy Policy, Travel Terms & Conditions, and any other policies, disclosures, disclaimers, registration terms, or agreements expressly incorporated or presented in connection with a particular Website feature, inquiry, account, booking, or service may also apply.

Users Under 18
The Website is intended solely for individuals who are at least eighteen (18) years of age. Individuals under the age of 18 are prohibited from using the Website, submitting inquiries, creating an account, registering for access to restricted areas of the Website, or providing personal information to Sea & Sun Travel Agency through the Website.

By accessing or using the Website, submitting information through the Website, or creating an account, you represent and warrant that you are at least 18 years of age. The Website provides information about Sea & Sun Travel Agency, travel destinations, travel experiences, hosted journeys, travel planning and advisory services, and other travel-related information, products, and services.

Website content is provided for general informational, educational, and promotional purposes. Viewing the Website, submitting an inquiry, joining a waitlist, requesting information, or creating an account does not by itself create a travel advisor-client relationship, confirm a reservation, guarantee availability, or obligate Sea & Sun Travel Agency to accept an engagement.

Travel planning, booking, reservation management, and other professional travel services provided by Sea & Sun Travel Agency are governed by our separate Travel Terms & Conditions and, when applicable, a Planning Agreement, Group Agreement, Destination Wedding Agreement or Guest Terms, registration terms, payment authorization, supplier terms, or other booking-specific agreement.

Inquiry Forms and Information Submitted Through the Website
The Website may contain inquiry forms, registration forms, waitlists, contact forms, booking requests, questionnaires, or other methods for submitting information. You agree that information you submit will be accurate, current, and complete to the best of your knowledge.

Submission of a form does not guarantee that Sea & Sun Travel Agency will accept the engagement, provide a proposal, hold inventory, confirm pricing, or make a reservation. When a Website form states that submission constitutes acknowledgment or acceptance of our Travel Terms & Conditions, Privacy Policy, or other identified terms, your submission constitutes your electronic acknowledgment and acceptance of those identified terms.

Personal information submitted through the Website is handled in accordance with our Privacy Policy and, where applicable, may be shared with service providers or travel suppliers as necessary to respond to your request or provide requested services.

Pricing, Availability and Travel Information
Travel prices, starting prices, promotions, itineraries, accommodations, amenities, dates, inclusions, photographs, descriptions, and availability displayed on the Website are subject to change and may be provided by third-party travel suppliers.

Unless expressly stated otherwise in a written confirmation issued for your reservation, Website content does not constitute a guarantee of price, availability, inventory, itinerary, room or stateroom category, airfare, amenities, supplier benefits, or any other travel component.

Travel requirements, destination conditions, passport or visa information, entry requirements, health requirements, supplier policies, and similar information may change without notice. Website information should not be treated as legal, medical, immigration, or other professional advice. Travelers remain responsible for verifying requirements applicable to their own circumstances.

Authorization
You represent, warrant, and covenant that you have the legal capacity and authority to accept these Terms and to provide any authorization, information, or consent you submit through the Website. If you register for an account or restricted-access area, you agree to provide accurate information and not to impersonate another person or entity or falsely represent your affiliation.

Term and Termination
These Terms become effective when you first access or use the Website and apply each time you subsequently access or use it. We may suspend, restrict, or terminate your access to the Website, an account, private page, or restricted-access feature in our discretion, including if we reasonably believe you have violated these Terms, created a security risk, engaged in unlawful or abusive conduct, misused Website content, or interfered with the rights of the Company or another person.

Provisions that by their nature should survive termination—including intellectual property, limitation of liability, indemnification, governing law, and dispute provisions—will survive.

Artificial Intelligence Usage
Sea & Sun Travel Agency, LLC may use artificial intelligence (“AI”) and AI-assisted technologies in connection with certain business and creative activities. This may include assisting with the development, drafting, editing, or refinement of marketing materials, social media content, written content appearing on this Website, and images or other visual content used on the Website, social media platforms, or other marketing materials.

AI-assisted content may be reviewed, edited, modified, or otherwise incorporated into materials created or published by Sea & Sun Travel Agency. The use of AI-assisted technologies does not alter the applicability of these Terms, our intellectual property rights, or any other policies, disclosures, disclaimers, or protections applicable to the Website or its content.

Website Availability
We will use commercially reasonable efforts to maintain the Website, but we do not guarantee uninterrupted or continuous availability. We may perform maintenance, updates, security work, or other changes at any time, with or without notice.

Account Registration

Unauthorized Linking, Backlinks, Framing and Association
Without Sea & Sun Travel Agency’s prior written consent, you may not create, establish, publish, maintain, purchase, direct, cause to be created, or knowingly facilitate any link, backlink, redirect, frame, embedded reference, domain association, or other electronic association involving the Website where the use falsely suggests sponsorship, endorsement, affiliation, partnership, authorization, or association with Sea & Sun Travel Agency.

You may not link the Website or Website content to, from, or in connection with any website, webpage, platform, content, service, network, or source that is unlawful, fraudulent, defamatory, obscene, pornographic, sexually explicit, malicious, deceptive, infringing, harmful, or otherwise reasonably likely to damage the reputation, security, goodwill, search-engine standing, or business interests of Sea & Sun Travel Agency.

You may not frame or mirror the Website or present Website content in a manner that obscures its source or creates a misleading impression regarding ownership, affiliation, sponsorship, or endorsement. Sea & Sun Travel Agency reserves the right to demand removal, disabling, disavowal, or other appropriate action concerning any link, backlink, redirect, frame, embedded reference, or association that we determine violates these Terms or is otherwise unauthorized.

Third-Party Websites and Services
The Website may contain hyperlinks to websites, booking platforms, social media platforms, products, services, applications, or content owned or operated by third parties. Sea & Sun Travel Agency does not control third-party websites or their content, availability, privacy practices, security, or terms.

Your use of a third-party website or service is subject to that third party’s terms and policies. To the fullest extent permitted by law, Sea & Sun Travel Agency is not responsible for loss or damage arising from your use of or reliance upon a third-party website, platform, product, or service.

Ownership and Intellectual Property
The Website and its content are owned by, licensed to, or otherwise lawfully used by Sea & Sun Travel Agency and its licensors or content providers. Digital Millennium Copyright Act (DMCA)

We do not represent or warrant that the Website or its contents will be error-free, uninterrupted, secure, accurate, useful, safe, reliable, current, complete, or produce any particular result, or that Website content or communications are free from viruses or other harmful components.

To the fullest extent permissible under applicable law, the Company disclaims all express or implied warranties relating to the Website and its contents, including warranties of title, merchantability, accuracy, completeness, condition, quality, performance, reliability, suitability, fitness for a particular purpose, and non-infringement.

Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, members, shareholders, directors, officers, employees, contractors, advisors, representatives, and agents from and against claims, proceedings, liabilities, losses, damages, costs, and reasonable attorney or expert fees arising from your acts or omissions, content you submit, violation of these Terms or the Privacy Policy, misuse of the Website, or violation of another person’s rights.

By using features that require personal information, you acknowledge that information may be processed as described in that policy and, where necessary, shared with service providers, technology providers, or travel suppliers.

General
Amendments. We may modify or update these Terms, the Privacy Policy, or Website content from time to time. The effective date of updated Terms will be identified when posted.

No Assignment. You may not assign or transfer these Terms without our prior written consent. The Company may assign its rights or obligations to an affiliated company or successor in connection with a merger, acquisition, reorganization, sale of assets, or similar transaction.

Severability. If any provision of these Terms is held unenforceable, that provision will be enforced to the fullest extent permitted by law and the remaining provisions will remain in effect.

No Waiver. Delay or failure to enforce a right does not waive that right or any later right.

Force Majeure. The Company is not liable for failure or delay in Website-related performance caused by circumstances beyond its reasonable control, including governmental action, court orders, natural disasters, fires, floods, storms, explosions, epidemics, pandemics, failures of power, internet, telecommunications or computer systems, labor disputes, civil unrest, war, or non-performance of third parties.

Third-Party Rights. These Terms are not intended to benefit or be enforceable by any third party except as expressly stated.

Headings. Titles and headings are for convenience only and do not affect interpretation.

Notices. Notices to the Company under these Terms should be sent to info@seaandsuntravelagency.com. Notices to you may be sent to an email address you provide to us.

Dispute Resolution. If a dispute arises under these Terms, the parties will use reasonable efforts to resolve it informally through direct communication before pursuing other remedies.

Governing Law. These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. To the extent a court proceeding is permitted or required, you consent to the jurisdiction of appropriate state or federal courts serving York County, South Carolina, subject to applicable law.

Entire Agreement. These Terms constitute the agreement between you and the Company concerning use of the Website. Travel services and bookings are separately governed by the Travel Terms & Conditions and any applicable booking-specific agreements. If a booking-specific agreement expressly conflicts with these Terms on a matter concerning travel services, the booking-specific agreement controls that travel-service matter.
