1. Agreement and Scope

In these Travel Terms & Conditions (“Terms”), “Sea & Sun Travel Agency,” “Agency,” “we,” “us,” and “our” mean Sea & Sun Travel Agency, LLC. “Traveler,” “you,” and “your” mean each person for whom travel services are requested or booked.

Sea & Sun Travel Agency provides professional travel-advisory, planning, booking, and reservation-management services and acts as an intermediary between travelers and independent travel suppliers. These Terms apply to travel services arranged through Sea & Sun Travel Agency and supplement any applicable Planning Agreement, Group Agreement, Destination Wedding Agreement, registration terms, payment authorization, proposal, invoice, and supplier terms.

By signing or electronically accepting an applicable agreement or registration, authorizing payment, paying a professional service fee or travel deposit, or otherwise instructing Sea & Sun Travel Agency to confirm travel arrangements after receiving these Terms, you acknowledge that you have reviewed and agree to them.

Supplier terms also apply to the travel products and services you purchase. If a supplier’s terms govern a supplier-provided service, fare, deposit, refund, change, cancellation, or other supplier obligation, the supplier’s applicable terms control that supplier-provided component. Sea & Sun Travel Agency’s professional service fees and agency-specific terms remain governed by your agreement with Sea & Sun Travel Agency.

2. Business Hours, Communication and In-Travel Support

Standard business hours are Monday–Thursday, 8:30 AM–6:00 PM Eastern Time; Friday, 8:30 AM–4:30 PM Eastern Time; Saturday by appointment; and Sunday closed for standard business. Email is the primary method for non-urgent communications, confirmations, deadlines, and documentation.

Clients traveling on arrangements booked through Sea & Sun Travel Agency have 24/7 access to the Agency for assistance with in-travel issues. This access does not guarantee an instantaneous response or a particular outcome. Resolution may depend upon the applicable airline, cruise line, resort, hotel, tour operator, transfer provider, insurer, or other supplier.

Travelers are responsible for reviewing Agency communications and promptly providing requested information, approvals, and payments. Failure to read an email, invoice, confirmation, or reminder does not extend a supplier or Agency deadline.

3. Independent Travel Suppliers

Airlines, cruise lines, hotels, resorts, tour operators, destination management companies, transfer providers, rental-car companies, excursion operators, insurers, and other providers are independent suppliers. Sea & Sun Travel Agency does not own, operate, manage, or control these suppliers.

Travel services are subject to the applicable supplier’s own terms, conditions, tariffs, contracts of carriage, policies, availability, and operational decisions. Travelers agree to review and comply with supplier terms provided or made available in connection with their reservation.

To the extent permitted by applicable law, Sea & Sun Travel Agency is not responsible for the acts, omissions, insolvency, bankruptcy, service failures, schedule changes, cancellations, delays, substitutions, or other conduct of independent suppliers. Sea & Sun Travel Agency will provide reasonable professional assistance and supplier advocacy for arrangements booked through the Agency.

4. Quotes, Pricing, Availability and Inclusions

All quotes and proposals are based on the specific services and inclusions identified in writing. Prices and availability may change at any time until the applicable supplier has received the required deposit or payment and confirmed the reservation.

Unless specifically stated as included, travelers should not assume that airfare, seat assignments, baggage, transfers, gratuities, resort or destination fees, local taxes, parking, porterage, meals, beverages, excursions, travel protection, visas, passport costs, vaccinations, or other incidental or personal expenses are included.

Government taxes, supplier surcharges, currency fluctuations, and other supplier-controlled charges may change when permitted by the supplier’s terms or applicable law.

5. Professional Service Fees

Sea & Sun Travel Agency may charge professional planning, flight-management, concierge, change, cancellation, restart, group, destination-wedding, or other service fees. The applicable fee and scope will be disclosed in the relevant agreement, registration, proposal, invoice, booking page, or other written communication before the fee is incurred whenever reasonably practicable.

Agency professional service fees are separate from supplier deposits, fares, penalties, and other travel costs. Unless expressly stated otherwise in writing, professional service fees are non-refundable once earned or incurred.

Where a specialized agreement or group-specific set of terms establishes a different Agency fee or service scope, that specialized agreement or those specific terms control for that engagement.

6. Reservations, Deposits and Payments

A reservation is not confirmed merely because a request, registration, proposal acceptance, or payment authorization has been submitted. Confirmation occurs only after the required payment has been successfully processed and the applicable supplier confirms the reservation.

Deposit amounts, refundability, transferability, payment schedules, and final-payment deadlines vary by supplier and reservation. The supplier-specific terms communicated for your booking control those requirements.

Travelers are responsible for making all required payments by the stated deadlines. Failure to make a required payment may result in cancellation, loss of inventory, price changes, forfeiture of amounts previously paid, or other supplier penalties.

Sea & Sun Travel Agency does not guarantee reinstatement of a reservation cancelled for nonpayment. Any reinstatement is subject to supplier approval, current availability, current pricing, and any applicable Agency or supplier fees.

Payments may be processed directly by a supplier or through an authorized payment process. Travelers authorize charges only as stated in the applicable payment authorization or booking process.

7. Payment Authorization and Fraud Prevention

By providing payment authorization, you authorize Sea & Sun Travel Agency and/or the applicable supplier or authorized payment processor to process the approved amount for the stated travel services or professional fees.

Sea & Sun Travel Agency may request reasonable identity-verification information when necessary to prevent fraud, protect travelers, or satisfy supplier or payment-processing requirements. Sensitive information should be provided only through Agency-approved secure methods.

If a payment is declined, reversed, disputed, or otherwise unsuccessful, the traveler remains responsible for any valid outstanding balance and any resulting supplier consequences, subject to applicable law.

8. Changes to Confirmed Reservations

Traveler-requested changes are subject to supplier availability, fare or rate differences, supplier terms, and any applicable Agency professional change fee disclosed for the reservation.

A $50 Sea & Sun Travel Agency professional change fee may apply to a significant traveler-requested modification when that fee is identified in the applicable agreement or booking terms. Significant changes may include reductions in nights, traveler-requested airfare changes or reticketing, changes in travelers when permitted, substantial changes to booked tours or excursions, or changes requiring substantial additional research, supplier communication, or rebooking.

An inquiry about whether a change is possible does not, by itself, constitute authorization to make the change. Sea & Sun Travel Agency will advise the traveler of known applicable costs before processing a requested change whenever reasonably practicable.

9. Cancellations and Unused Services

Cancellation requests must be submitted to Sea & Sun Travel Agency in writing. A reservation is not considered cancelled until the cancellation has been processed with the applicable supplier.

Sea & Sun Travel Agency charges a professional cancellation fee when a confirmed travel reservation is cancelled. The applicable fee is based on the total cost of the trip booked through Sea & Sun Travel Agency, as shown below. This Agency cancellation fee is separate from and in addition to any cancellation penalties, forfeited deposits, non-refundable payments, fare differences, or other charges imposed by travel suppliers.

For purposes of this fee schedule, “total trip cost” means the total value of the travel arrangements booked through Sea & Sun Travel Agency for the reservation being cancelled. If a specialized Group Travel Agreement, Destination Wedding Guest Terms & Conditions, or other written agreement expressly establishes a different Agency cancellation fee, the more specific written terms control for that reservation.

Supplier cancellation penalties are governed by the applicable supplier’s terms and may increase as the departure date approaches. Refund eligibility and timing are also subject to supplier rules and applicable law.

No refund is due from Sea & Sun Travel Agency for unused or partially used travel services unless required by applicable law or provided by the applicable supplier’s terms. Travelers should promptly notify the Agency if they will not use a confirmed service so the Agency can assist where possible.

10. Refunds, Credits and Payment Disputes

Refunds and future travel credits are subject to the applicable supplier’s eligibility rules, processing procedures, and timelines. Sea & Sun Travel Agency cannot issue supplier funds that the Agency has not received or is not authorized to return.

Claims for refunds or adjustments should be submitted promptly with the relevant booking information and supporting documentation. Supplier terms are separate from Sea & Sun Travel Agency’s terms, and supplier refund policies control supplier-held funds.

You waive any right to initiate a chargeback, payment reversal, or recollection of an authorized travel payment because of cancellation, supplier penalties, a Force Majeure event, dissatisfaction with a supplier-provided service, or a refund or credit being processed in accordance with the applicable supplier or Agency terms, except in the case of actual fraud or a genuinely unauthorized transaction. A transaction is not unauthorized merely because you later cancel, decide not to travel, disagree with an applicable cancellation penalty, or are dissatisfied with a travel service after having authorized the charge.

By submitting a signed or electronic credit-card authorization, payment authorization, registration, or other written approval for Sea & Sun Travel Agency to arrange or pay for travel on your behalf, you acknowledge that the resulting authorized charges are valid travel transactions. You agree not to falsely characterize an authorized transaction as fraudulent or unauthorized.

If you initiate a chargeback, reverse, or attempt to recollect a valid authorized payment contrary to these Terms, Sea & Sun Travel Agency may contest the dispute and provide the financial institution or payment processor with your signed authorization, booking records, invoices, communications, supplier confirmations, supplier terms, and other relevant documentation. To the extent permitted by applicable law, you agree to be responsible for reasonable costs, fees, and expenses incurred by Sea & Sun Travel Agency in responding to or collecting amounts associated with an improper or fraudulent chargeback, including reasonable attorney fees when applicable.

11. Traveler Names, Identification, Passports, Visas and Entry Requirements

Traveler names must be provided exactly as required by the applicable supplier and must match the passport or other identification used for travel. Travelers are responsible for promptly reviewing confirmations and reporting errors. Costs associated with correcting traveler-provided information are the traveler’s responsibility.

Each traveler is solely responsible for obtaining and carrying the passports, visas, electronic travel authorizations, identification, health documentation, consent letters for minors, and other documents required for the itinerary, including transit points and return travel.

Sea & Sun Travel Agency requires travelers planning international travel to have a passport that will remain valid for at least six months beyond the scheduled return date. This is a conservative Agency standard intended to reduce the risk of travel disruption when itineraries change or additional destinations are added. Individual countries may impose shorter, longer, or otherwise different passport-validity and blank-page requirements. Travelers remain solely responsible for verifying and satisfying the specific entry, transit, and passport requirements applicable to every destination on their itinerary.

Sea & Sun Travel Agency may provide general information and links to official resources as a convenience, but travelers remain responsible for verifying current requirements with the appropriate government authorities. Denied boarding or entry resulting from insufficient or incorrect documentation does not create a right to an Agency refund.

For U.S. domestic air travel, travelers age 18 or older must present identification accepted by the Transportation Security Administration. Travelers should verify current TSA identification requirements before departure.

12. Air Travel

Airline fares, ticket rules, baggage allowances, seat assignments, schedules, and refund/change conditions vary by carrier and fare type. Travelers are responsible for reviewing the applicable airline rules.

Depending on the airline, fare class, ticket type, and rules applicable to the ticket purchased, change and cancellation fees and penalties may apply up to 100% of the applicable fare paid. Certain fares and tickets are NON-REFUNDABLE and/or NON-EXCHANGEABLE once purchased. Travelers are responsible for the fare rules applicable to their ticket, and any refund, exchange, credit, reissue, or change is subject to the airline’s rules, supplier terms, and applicable law.

Seat assignments are requests or selections controlled by the airline and may be changed by the carrier, including after a seat fee has been paid. Sea & Sun Travel Agency cannot guarantee a particular seat, adjacent seating, aircraft type, schedule, or connection.

When Sea & Sun Travel Agency provides separate flight-management services, the applicable professional fee and scope will be disclosed before those services are undertaken. Airline-imposed charges remain separate.

13. Accommodations and Special Requests

Hotels, resorts, villas, cruise accommodations, and other lodging are subject to supplier availability and the property’s terms. Room location, bedding configuration, adjoining or connecting rooms, views, early check-in, late check-out, and other special requests cannot be guaranteed unless the supplier expressly confirms them as guaranteed.

Property amenities and services may be modified, unavailable, seasonal, temporarily closed, or affected by maintenance or operational conditions. Sea & Sun Travel Agency will assist with supplier communication when appropriate but does not control property operations or supplier reimbursement decisions.

14. Dietary, Accessibility and Special Travel Needs

Travelers should advise Sea & Sun Travel Agency as early as possible of accessibility needs, mobility requirements, dietary requests, service-animal arrangements, or other special requests that must be communicated to suppliers.

Sea & Sun Travel Agency will communicate reasonable requests to suppliers but cannot guarantee that a supplier, destination, transportation provider, venue, or property can accommodate every request. Accessibility standards, infrastructure, and legal requirements vary by destination.

Travelers are responsible for determining whether an itinerary, activity, accommodation, or transportation arrangement is suitable for their individual needs and abilities and for consulting appropriate medical or other professionals when necessary.

15. Travel Protection

Sea & Sun Travel Agency strongly recommends that travelers consider comprehensive travel protection appropriate to their trip, including coverage that may address trip cancellation, trip interruption, travel delay, baggage, emergency medical expenses, and medical evacuation.

Sea & Sun Travel Agency may provide information or quotes for available plans but is not the insurer and does not determine coverage or claim eligibility. The insurance policy and insurer control all coverage, exclusions, definitions, benefits, and claim decisions.

Travelers are responsible for reviewing policy terms, purchasing coverage within any applicable eligibility period, and deciding whether a plan meets their needs. If coverage is declined, the traveler accepts the financial risks associated with traveling without that protection.

16. Health, Safety and Destination Conditions

Travel conditions can be affected by disease outbreaks, public-health requirements, weather, civil unrest, crime, strikes, government action, natural disasters, or other events. Travelers are responsible for monitoring current conditions and complying with applicable government and supplier requirements.

Sea & Sun Travel Agency may provide general travel information but does not provide medical, legal, immigration, or safety advice. Travelers should consult official government sources and qualified professionals regarding their individual circumstances.

Requirements and conditions may change before or during travel. Costs resulting from quarantine, testing, medical treatment, evacuation, denied boarding or entry, or other traveler-specific circumstances are the traveler’s responsibility unless covered by a supplier or insurance policy.

17. Minors

Age requirements for hotels, resorts, cruises, tours, activities, and transportation vary by supplier and itinerary. The applicable supplier’s rules control.

Adults traveling with minors are responsible for ensuring that all required identification, passports, visas, consent letters, custody documentation, and other documents are carried. Requirements may vary when a minor travels alone, with one parent, or with an adult who is not a parent or legal guardian.

Parents and guardians are responsible for the supervision and safety of minors traveling with them.

18. Traveler Conduct

Travelers are expected to comply with applicable laws, supplier rules, safety instructions, and reasonable standards of conduct. A supplier may deny service, remove a traveler, or terminate participation when permitted by its rules or applicable law because of unsafe, abusive, threatening, disruptive, unlawful, or materially inappropriate conduct.

A traveler removed from a service or denied participation because of their conduct is responsible for resulting expenses and may not be entitled to a refund, subject to supplier terms and applicable law.

Travelers are responsible for their personal belongings and for damage or loss they cause to property or third parties.

19. Adventure, Expedition and Higher-Risk Activities

Certain itineraries and activities—including expedition cruising, wildlife encounters, remote-region travel, hiking, kayaking, high-altitude activities, water activities, and other adventure experiences—may involve increased physical demands, environmental hazards, limited medical facilities, and delayed emergency response.

Travelers are responsible for reviewing supplier activity requirements, assessing their ability to participate, following safety instructions, and obtaining any required or appropriate insurance. Suppliers may require separate waivers or medical forms.

For trips involving materially higher-risk activities, Sea & Sun Travel Agency may require a separate activity-specific acknowledgment or waiver.

20. Force Majeure and Events Beyond Control

Sea & Sun Travel Agency is not responsible for delay, change, cancellation, or nonperformance caused by events beyond the Agency’s reasonable control, including severe weather, natural disasters, fire, flood, epidemic or pandemic, government action, war, terrorism, civil unrest, strikes, transportation disruption, supplier failure, or similar events.

When such an event affects travel, supplier terms and applicable law determine whether a refund, credit, substitution, itinerary change, or other remedy is available. Sea & Sun Travel Agency will provide reasonable assistance and supplier advocacy but cannot guarantee a particular remedy.

21. Groups and Destination Weddings

Travelers participating in a group or destination wedding are also subject to the applicable Group Travel Terms & Conditions, Destination Wedding Guest Terms & Conditions, group registration terms, and/or group supplier contract.

Group-specific terms may establish different deposit schedules, Agency fees, cancellation provisions, room-block requirements, participation requirements, or other conditions. Where a group-specific term directly addresses the same subject as these general Terms, the more specific group term controls for that group reservation.

22. Photography and Submitted Content

Sea & Sun Travel Agency may photograph or record Agency-hosted trips, events, or activities. When practicable, participants will be informed of planned Agency photography or recording and may notify the Agency if they do not wish to be intentionally featured.

If a traveler voluntarily submits photographs, videos, testimonials, or other content to Sea & Sun Travel Agency for promotional use, the traveler represents that they have the right to share the content and grants the Agency permission to use it for Agency marketing and promotional purposes unless otherwise agreed in writing.

Sea & Sun Travel Agency will not intentionally publish sensitive personal identifying information as part of promotional content without appropriate permission.

23. Privacy and Personal Information

Sea & Sun Travel Agency collects and uses personal information reasonably necessary to provide travel-advisory and booking services, communicate with travelers, process authorized transactions, prevent fraud, administer client relationships, and satisfy legal or supplier requirements.

To arrange travel, the Agency may need to share relevant information with travel suppliers, payment processors, technology providers, insurers, host-agency or consortium partners, and other service providers involved in the reservation. Some recipients may be located outside the United States and may be subject to different privacy laws.

Sea & Sun Travel Agency uses reasonable administrative and technical safeguards appropriate to its operations, but no method of electronic transmission or storage can be guaranteed completely secure. Travelers should use Agency-approved secure methods when submitting sensitive information.

Any separate Privacy Policy published by Sea & Sun Travel Agency is incorporated by reference to the extent applicable.

24. Agency Right to Decline or Terminate Services

Sea & Sun Travel Agency may decline new work or terminate an advisory relationship when reasonably necessary, including for nonpayment, fraud concerns, abusive or threatening conduct, repeated failure to provide information or approvals required to service the reservation, requests that would require unlawful or unethical conduct, or a material breakdown in the professional relationship.

When an active reservation exists, Sea & Sun Travel Agency will take reasonable steps consistent with supplier rules and applicable law to communicate the status of booked arrangements and any traveler actions required. Termination of Agency services does not cancel supplier obligations, balances, penalties, or terms already applicable to confirmed travel.

25. Complaints and Resolution

Travelers are encouraged to notify Sea & Sun Travel Agency promptly of concerns so the Agency has a reasonable opportunity to assist. Issues occurring during travel should be reported as soon as practicable to both the applicable supplier and Sea & Sun Travel Agency when assistance is requested.

Nothing in these Terms restricts a traveler from making truthful statements, submitting a review, contacting a regulator, or exercising rights protected by applicable law.

26. Independent Travel Advisors

Sea & Sun Travel Agency may work with independent travel advisors who operate as independent contractors affiliated with the Agency. Travel arranged through an affiliated advisor remains subject to the applicable Sea & Sun Travel Agency agreements and terms identified for the reservation.

27. Limitation of Liability

As we provide a service as a booking agent to provide travel products including tours, cruises, hotels, airlines tickets and rental cars from suppliers and airlines, we are only paid via commissions from such supplier(s) and fees we may charge directly to our clients.

You agree, by signing these Terms and Conditions, that if a court of competent jurisdiction enjoins us to suit that you have filed, the amount we may be held liable for is the total of any commissions and/or fees that we have or will receive in regard to your trip.

28. Dispute Resolution; Governing Law and Venue

The parties will first attempt in good faith to resolve disputes directly. Any arbitration requirement, class-action waiver, jury-trial waiver, limitation period, governing-law provision, or venue requirement should be applied only to the extent enforceable under applicable law.

Unless otherwise required by applicable law or a controlling written agreement, South Carolina law governs the relationship between Sea & Sun Travel Agency and the traveler, without regard to conflict-of-law principles, and permitted court proceedings shall be brought in an appropriate state or federal court serving York County, South Carolina.

NOTE FOR FINAL LEGAL REVIEW: Sea & Sun Travel Agency’s current terms contain a mandatory binding-arbitration provision. Because enforceability and required disclosures can be fact-specific, the final arbitration language should be reviewed by qualified counsel before publication rather than copied forward unchanged.

29. State Seller-of-Travel and Consumer Disclosures

Washington State: If transportation or other services are cancelled by the seller of travel, all sums paid to the seller of travel for services not performed in accordance with the contract between the seller of travel and the purchaser will be refunded within thirty days of receiving the funds from the vendor with whom the services were arranged, or, if the funds were not sent to the vendor, the funds shall be returned within fourteen days after cancellation by the seller of travel to the purchaser, unless the purchaser requests that the seller of travel apply the money to another travel product and/or date.

California Residents: Sea & Sun Travel Agency, LLC is not required to be a participant in the State of California Travel Consumer Restitution Fund (TCRF).

Sea & Sun Travel Agency will provide any additional seller-of-travel registration numbers, statutory notices, trust-account disclosures, refund notices, or other state-specific disclosures required by applicable law for a particular transaction.

30. Entire Agreement; Severability; No Waiver

These Terms, together with the applicable Planning Agreement, Group Agreement, Destination Wedding Agreement, registration terms, payment authorization, proposal, invoice, and incorporated supplier terms, constitute the agreement governing the applicable services.

If a provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A delay or failure to enforce a provision does not waive the right to enforce it later.

31. Changes to These Terms

Sea & Sun Travel Agency may update these Terms from time to time. The version provided, accepted, or incorporated when a traveler enters into a particular booking or service engagement will govern that engagement unless the parties agree otherwise or a change is required by law.

The current website version may be updated for future bookings without retroactively changing a traveler’s material contractual rights or obligations for an existing confirmed engagement unless permitted by applicable law.

32. Acceptance

By signing or electronically accepting an applicable agreement or registration, authorizing payment, paying an applicable professional service fee or travel deposit, or instructing Sea & Sun Travel Agency to confirm travel arrangements after receiving these Terms, you acknowledge that you have read, understand, and agree to these Travel Terms & Conditions and the applicable supplier terms.
